The President’s Office announced in a notice that day, “President Yoon approved the ‘Request for Reconsideration of the Act on Special Prosecutors for Marines Killed in the Line of Duty’, which was passed at the Cabinet meeting chaired by Prime Minister Han Deok-soo.”

The President’s Office emphasized, “With the actual truth and responsibility revealed as a result of the police investigation announced yesterday, the law on special prosecutors for fallen marines killed in the line of duty, which the opposition party unilaterally pushed, must now be withdrawn.”

He went on to say, “There should no longer be any misuse of the unfortunate death of a Marine who died while performing his duty at the call of his country for political purposes,” adding, “Once again, I pray for the rest of the soul of the Marine who died in the line of duty, and offer my deepest condolences to his bereaved family.” He added.

This is the 8th time that President Yoon has requested the National Assembly to reconsider a bill, and the 15th in number.

The day before, the police announced the results of the investigation into the death of Corporal Chae of the Marine Corps and decided to send six on-site commanders at the time of the accident, including the commander of the 7th Brigade of the 1st Marine Division, to charges of professional negligence causing death.

However, the decision was made not to forward Lim Seong-geun, the former commander of the 1st Marine Division, who was accused of professional negligence and manslaughter, after determining that there were no charges against him.

In the meantime, the opposition party has raised suspicions that President Yoon exerted external pressure to exclude former division commander Lim from the list of suspects after receiving the results of the initial investigation by the Marine Corps investigation team, which acknowledged the charges against former division commander Lim.

Previously, on May 21, President Yoon exercised his veto on the Special Prosecutor Chae Sang-byeong Act, which was passed solely by the opposition party in the 21st National Assembly, and this bill was scrapped on May 28 after a re-vote by the National Assembly.

However, the Democratic Party of Korea again proposed the Chae Sang-byeong Special Prosecutor Act as its ‘Party No. 1’ in the 22nd National Assembly. In particular, the bill for relapse requires special prosecutors to investigate not only the death of Chae Sang-byeong in the line of duty, but also all related issues, and further raises the bar by expanding the opposition party’s authority to recommend special prosecutors.

So far, the President’s Office has maintained its position that the Special Prosecutor Chae Sang-byeong Act, which grants the opposition party the right to recommend special prosecutors, is an unconstitutional law that infringes on the president’s right to appoint public officials and violates the separation of powers.

President Yoon, who is visiting the United States to attend the 2024 North Atlantic Treaty Organization (NATO) Summit, approved the request for reconsideration of the Special Prosecutor Chae Sang-byeong Act in Hawaii about three hours after it passed the Cabinet meeting.

The President’s Office initially considered approving the request for reconsideration after attending the NATO summit, but it was reported that they exercised their right to request reconsideration on this day after the results of a police investigation found that former division commander Lim was not guilty the previous day.
